Summary

The Special Lok Adalat of the High Court at Aurangabad heard Civil Application No. 5939 of 2018, wherein New India Assurance Co. Ltd. sought to withdraw its appeal against the award of the Motor Accident Claims Tribunal. The court condoned the delay in filing the appeal and ordered its registration. The insurance company submitted a withdrawal pursis and an authority letter, indicating acceptance of the Tribunal’s award. One of the claimants, Sharlet Rameshwar Khadse, had died, and the court directed that the compensation be redistributed equally among the surviving claimants with accrued interest. The court ordered that the deposited compensation be released to the claimants without further reference to its own order and that the appeal be deemed disposed. It also directed the insurer to inform the claimants of the withdrawal and to process any refund of court fees.

Issues considered

  • Whether the appeal filed by the insurance company can be withdrawn after delay.
  • How the compensation awarded by the Motor Accident Claims Tribunal should be distributed among the remaining claimants after the death of one claimant.
  • Whether the delay in filing the appeal can be condoned under the applicable provisions.
