Holding

The court condoned the delay, granted a stay of execution, and permitted withdrawal of 60% of the deposited amount with conditions.

Summary

The applicants sought condonation of a 30‑day delay in filing their first appeal, a stay of execution of the impugned judgment and award, and permission to withdraw a portion of the amount they had deposited in the court. The court, after hearing counsel, condoned the delay in the interest of justice and ordered the appeal to be registered. It granted a stay of the judgment and award pending the appeal. Regarding the withdrawal, the court allowed the applicants to withdraw 60% of the deposited amount with accrued interest upon furnishing an undertaking, while the balance was to remain in fixed deposit until the appeal is disposed. The applications for condonation, stay, and partial withdrawal were thus allowed, and the appeal proceeded.
