The appeal is disposed of as withdrawn, and the award of the Motor Accident Claims Tribunal stands, with the insurer directed to pay the compensation to the claimants.

Summary

The New India Assurance Company Limited filed a first appeal (No. 2993 of 2013) before the Special Lok Adalat of the High Court of Bombay, Aurangabad, challenging the award of the Motor Accident Claims Tribunal, Ahmednagar, in a 2005 motor accident claim. The appellant submitted a withdrawal pursis dated 25‑03‑2026, indicating its acceptance of the Tribunal’s award and its intention to withdraw the appeal. The court noted that the compensation amount, along with accrued interest, had already been deposited with the registry for payment to the claimants. Consequently, the court ordered the first appeal and the pending civil applications to be disposed of, directing the insurer to pay the awarded amount to the claimants and to communicate the withdrawal. The court also directed that the refund of court fees be processed as per law.

Issues considered

  • Whether the appellant can withdraw its first appeal after accepting the award of the Motor Accident Claims Tribunal
