All the first appeals and any pending civil applications are disposed of upon the insurer’s withdrawal of the appeals.
Summary
The Special Lok Adalat of the Bombay High Court, Aurangabad bench, considered a batch of first appeals filed by New India Assurance Company Ltd. against various claimants in motor accident claim petitions. The insurer had earlier accepted the awards of the Motor Accident Claims Tribunal and the compensation amounts had been deposited with the Court registry. The insurer subsequently filed withdrawal pursis and authority letters, seeking to withdraw all the appeals and any pending civil applications. The Court held that, on receipt of the withdrawal, the appeals stand disposed and the claimants may withdraw the deposited compensation with accrued interest as directed by the Tribunal. Accordingly, the Court ordered the awards to be drawn, the insurer to inform the claimants, and the refund of court fees to be processed.
Issues considered
- Whether a first appeal filed before the Special Lok Adalat can be dismissed upon the appellant’s withdrawal of the appeal.
- Effect of withdrawal of appeal on any pending civil applications related to the same motor accident claim.
