All the first appeals filed by Reliance General Insurance Company are disposed of following the insurer's withdrawal and the deposit of compensation with the Court registry.
Summary
The Special Lok Adalat of the Bombay High Court, Aurangabad bench, heard a batch of first appeals filed by Reliance General Insurance Company challenging awards of the Motor Accident Claims Tribunal. The insurer submitted an email instruction, on behalf of its advocate, to withdraw all the appeals and confirmed that the compensation amounts had been deposited with the Court registry. The Court, after condoning the delay, allowed the claimants to withdraw the compensation and accrued interest as directed by the Tribunal, and ordered that the appeals and any pending applications be disposed of. The award was to be drawn up accordingly, and the insurer undertook to inform the claimants and their counsel of the withdrawal. The Court also directed that any refund of court fees be processed as per law.
Issues considered
- What is the appropriate procedure for withdrawing multiple first appeals in a Special Lok Adalat?
- Whether the Court should condone the delay in filing the withdrawal request.
- Whether claimants may withdraw the deposited compensation and interest without further Court order.
