All the first appeals and related applications are disposed of upon acceptance of the insurance company's withdrawal.
Summary
The Special Lok Adalat of the Bombay High Court, Aurangabad Bench, heard a batch of first appeals filed by Reliance General Insurance Co. against various claimants in motor accident claim petitions. The insurance company, through its advocate Mr. R.H. Dahat, submitted email instructions withdrawing all the appeals and indicated that the compensation awarded by the Motor Accident Claims Tribunal had been deposited with the Court registry. The Court condoned the delay in filing the applications, accepted the withdrawal, and directed that claimants could withdraw the deposited amounts with accrued interest as per the Tribunal's directions. Consequently, the Court ordered that all the first appeals, as well as any pending civil applications and X‑objections, stand disposed of and that the award be drawn up accordingly. The insurance company also undertook to inform the claimants and their counsel of the withdrawal and to seek refund of court fees.
Issues considered
- Whether the delay in filing the applications should be condoned.
- Whether the insurance company's withdrawal of the first appeals can be accepted without further adjudication.
- Whether the claimants are entitled to withdraw the deposited compensation amounts with interest.
