Holding

The court upheld the validity of the will, ordered the heirs to be joined as non‑applicants, and directed the specified distribution of compensation.

Summary

The land of the late Vasant Ghanshyamdas Haujawala was acquired under the National Highways Act, 1956 and a compensation award was issued. NHAI challenged the award via a petition under Section 34 of the Arbitration and Conciliation Act, 1996, but the petition and the subsequent arbitration appeal were dismissed. The deceased had executed a will bequeathing the compensation to his wife Varsha and daughter‑in‑law Vaishali, while his son and daughter were Class‑I legal heirs. The court ordered the heirs to be joined as non‑applicants, accepted affidavits confirming the will, and permitted the applicants to withdraw the amount deposited by NHAI. It directed that half of the compensation (with interest) go to Varsha and the remaining half be split equally between Varsha and Vaishali, each receiving a quarter share with interest.

Issues considered

  • Whether NHAI could successfully challenge the compensation award under Section 34 of the Arbitration and Conciliation Act, 1996.
  • Whether the will executed by the deceased validly determines the distribution of the compensation.
  • Who are the proper beneficiaries of the compensation after the landowner’s death.
  • Whether the Class‑I legal heirs must be joined as parties to the proceeding.
