Bombay High Court

KESHAVRAO PATILBA DAPKEversusSTATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The petition stands disposed as the underlying proceedings have been closed, leaving no surviving claim.

Summary

The petitioner, Keshavrao s/o Patilba Dapke, filed a writ petition (No. 4975 of 2015) along with a civil application (No. 858 of 2022) challenging actions of the State of Maharashtra. The Court initially granted leave to amend the petition, directing that any amendment be filed within four weeks. On the expiry of that period, counsel for the petitioner informed the Court that the authority concerned had closed the proceedings underlying the petition, and therefore no substantive relief remained to be claimed. The petitioner submitted a copy of the closure communication, which was placed on record. The Court held that, in view of the closure, the petition could no longer proceed and consequently ordered the petition to stand disposed, with the pending civil application also disposed.
