DISPOSED OFF

Holding

The withdrawal of the first appeal by the insurer is permissible, leading to the disposal of the appeal and related civil applications.

Summary

The New India Assurance Company filed first appeals and several civil applications in the Special Lok Adalat challenging awards of the Motor Accident Claims Tribunal in Ahmednagar. The insurer later submitted a withdrawal pursis and an authority letter, indicating its acceptance of the Tribunal awards. The panel considered whether the withdrawal of the appeals was permissible. It held that the withdrawal was valid and consequently disposed of the first appeals and the pending civil applications. The court directed that the award be drawn up, the insurer communicate the withdrawal to claimants, and that any court fee refund be processed as per law.
