Bombay High Court

THE STATE OF MAHARASHTRA THROUGH ITS COLLECTOR BEED AND ORSversusEKNATH MANIK POKALE

Disposal
DISPOSED OFF

Holding

The civil applications do not survive the disposal of the first appeals and are therefore dismissed.

Summary

The State of Maharashtra, through the Collector of Beed, filed several civil applications (Nos. 9149, 9147, 9151, 9141, 9145, 9143 of 2023) in conjunction with first appeals (Nos. 372, 374, 377, 375, 373, 376 of 2026) against various respondents of the Pokale family. Each civil application sought relief that was dependent on the outcome of the corresponding first appeal. The High Court observed that all the first appeals had already been disposed of, leaving no surviving cause of action in the pending civil applications. Consequently, the Court held that the civil applications could not proceed and ordered their disposal. The order was pronounced by Justice Shailesh P. Brahme on 18 April 2026.
