Disposal
DISPOSED OFF

Holding

The execution of the impugned award shall remain stayed till final disposal of the appeal.

Summary

The National Highways Authority of India (NHAI) deposited fifty percent of the compensation amount determined by an arbitral tribunal, which had been upheld by the Principal District Judge after rejecting a petition under Section 34 of the Arbitration and Conciliation Act, 1996. The High Court stayed the execution of the award pending the final disposal of the appeal against the award. The court also permitted the land‑owners (respondents) to apply for withdrawal of the amount already deposited. Consequently, the civil application filed by NHAI was disposed of. The decision underscores the principle that execution of an arbitral award may be stayed while an appeal is pending.

Issues considered

  • Whether the execution of an arbitral award can be stayed pending the final disposal of an appeal.
  • Whether the petition under Section 34 of the Arbitration and Conciliation Act, 1996 was correctly dismissed.
  • Whether the respondents are entitled to withdraw the amount deposited by the appellant.
