Bombay High Court

SAINT SAKHUBAI MAHILA BACHAT GAT THROUGH ITS PRESIDENT PRATIBHA SHIVAJI JAYABHAYEversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court ordered the District Supply Officer to complete the inquiry within three months and disposed both the writ petition and the related civil application.

Summary

The petitioner, Savitrabai Phule Mahila Bachat Gutthi, challenged orders dated 1 November 2017 by the Minister (Food, Civil Supply and Consumer Protection) and 31 July 2017 by the Deputy Commissioner (Supply) in Aurangabad. The Deputy Commissioner had allowed a revision filed by Respondent No.4 and directed the District Supply Officer to conduct an inquiry. The petitioner sought expeditious completion of that inquiry, arguing undue delay since the matter had been pending since 2018. The High Court directed the District Supply Officer in Nanded to complete the inquiry within three months and to decide in accordance with the applicable policy. Consequently, the writ petition was disposed, and the accompanying civil application was also dismissed as it could not survive the disposal of the writ petition.

Issues considered

  • What authority does the High Court have to direct the expeditious completion of an administrative inquiry under the supply department?
  • Does a civil application filed in conjunction with a writ petition survive the disposal of the writ petition?

                                      CORAM : SIDDHESHWAR S. THOMBRE, J.

               P.C.:-

               1. Heard learned Advocates for the respective parties.

               2. By the present petition, the Petitioner is aggrieved by the

order dated 01.11.2017 passed by the learned Minister (Food, Civil

Supply and Consumer Protection) in Case No. VAM/1117/Prakra-

156/Napu-21, as well as the order dated 31.07.2017 passed by the

               learned Deputy Commissioner (Supply), Aurangabad.
                                            2 of 2 901-WP.14595.2017.odt

          3. The learned Deputy Commissioner (Supply), Aurangabad,

allowed the revision preferred by Respondent No.4 and directed the

District Supply Officer to conduct an inquiry and pass an appropriate

order. Considering that the present petition has been pending since

2018 and that an alternate arrangement has already been made, it

would be appropriate to direct expeditious completion of the inquiry.

          4. Accordingly, the District Supply Officer, Nanded, is directed

to complete the inquiry within a period of three months from today

and thereafter take a decision in accordance with the applicable policy.

          5. Hence, the present petition is disposed of.

          6. In view of disposal of writ petition, civil application does not

survive and it is also disposed of.

                                                (SIDDHESHWAR S. THOMBRE, J.)
