SOPAN GHANSHYAM SAPKALEversusJOINT COMMISSIONER SCHEDULED TRIBE CERTIFICATE SCRUTINY COMMITTEE AND OTHERS

Disposal
DISPOSED OFF

Holding

The court allowed the petitioner to produce the additional documents on record.

Summary

The petitioner, Sopan GhanShyam Sapkale, filed a civil application seeking permission to submit additional documents, including a certificate of validity granted to a near relative by the Scrutiny Committee and fresh genealogical records, to support his claim for a Scheduled Tribe certificate. The respondent, the Joint Commissioner and others, opposed the amendment. The court examined whether the petitioner could be allowed to introduce these new documents after the original petition was filed. Considering the relevance of the new evidence and the procedural rules, the judges permitted the petitioner to file the documents as exhibits R-1 and R-2 within two weeks. The application was allowed, and the petition was scheduled to be placed on the board on 21 September 2026.
