The court held that a valid arbitration agreement existed and was duly invoked, and therefore appointed Mr. Cyrus Jal as the sole arbitrator to adjudicate the disputes.

Summary

The applicant, PGD Skyline LLP, filed an application under Section 11 of the Arbitration and Conciliation Act, 1996 seeking the appointment of an arbitrator to resolve disputes arising from an agreement dated 31 March 2022. The court examined the arbitration clause (Clause 26) and found that a valid, subsisting arbitration agreement existed and had been duly invoked by the applicant's notice dated 5 February 2026. Consequently, the court ordered the appointment of Mr. Cyrus Jal as the sole arbitrator and directed the parties to cooperate with the arbitrator on procedural matters. The court also directed the arbitrator to file a statutory statement of disclosure under Section 11(8) and Section 12(1) and stipulated that arbitration costs be borne equally by the parties, subject to the final award. The application was disposed of in accordance with the order.

Issues considered

  • Whether a valid arbitration agreement exists between the parties.
  • Whether the arbitration agreement has been properly invoked under Section 11 of the Arbitration and Conciliation Act, 1996.
