The court held that a valid arbitration agreement exists and, under Section 11 of the Arbitration and Conciliation Act, 1996, appointed Mr Ashish Venugopal as the sole arbitrator.

Summary

The applicant, Enrich Global Infra Ltd., filed an application under Section 11 of the Arbitration and Conciliation Act, 1996 seeking the appointment of an arbitrator pursuant to an arbitration clause in an agreement dated 2 November 2017. The applicant served a notice of arbitration on 8 September 2025, but the respondent, Upasani, neither replied nor filed any affidavit. The court examined the record and concluded that a valid and subsisting arbitration agreement exists and that it has been duly invoked. Consequently, the court appointed Mr Ashish Venugopal as the sole arbitrator and issued procedural directions for disclosure, communication, and cost sharing. All substantive issues are left open for determination by the appointed arbitral tribunal.

Issues considered

  • Whether a valid and subsisting arbitration agreement exists between the parties.
  • Whether the court can appoint a sole arbitrator under Section 11 of the Arbitration and Conciliation Act, 1996 when the respondent remains silent.
  • Whether the respondent’s failure to respond to the notice of arbitration affects the appointment of the arbitrator.

                                                 DATED : AUGUST 27, 2026

                   P.C.:
                   1. The present Application has been filed under Section 11 of
the Arbitration and Conciliation Act, 1996 (“the Act”), seeking
appointment of an arbitrator in respect of the disputes and
differences stated to have arisen between the parties under the
Agreement dated 2 November 2017, a copy whereof is annexed
at pages 55 to 57 of the Application. The arbitration agreement
is contained in the second-last paragraph of Clause, appearing at

arbitration agreement is not reproduced herein. Suffice it to note

2. The record indicates that the Applicant invoked the
arbitration agreement by issuing a notice dated 8 September
2025. Despite service of the said notice, the Respondent has
neither furnished any reply thereto nor filed any affidavit in
reply to the present Application.

that the arbitration agreement has been duly invoked by the
Applicant.

said agreement has been duly invoked. It would, therefore, be
appropriate to refer the disputes and differences arising out of or
in connection with the aforesaid Agreement to arbitration before
a Sole Arbitrator.

filed under Section 11 of the Act is disposed of in terms of the
