The Court held that a valid arbitration agreement subsists and therefore appointed a sole arbitrator to adjudicate the disputes.
Summary
The applicant, Surjit Singh & Bros, filed an application under Section 11 of the Arbitration and Conciliation Act, 1996 seeking the appointment of an arbitrator to resolve disputes arising under clause 51 of the General Conditions of Sub‑Contract in work order AFC/SUB/287 dated 30‑Jan‑2021. The High Court examined whether a valid and subsisting arbitration agreement existed between the parties. Finding that the arbitration clause was undisputed and enforceable, the Court ordered that the disputes be referred to a sole arbitrator with Mumbai as the seat of arbitration. Justice Amit Borkar appointed Mr. Tushad Kakalia as the sole arbitrator and directed the parties to comply with statutory disclosure requirements under Sections 11(8) and 12(1). The Court also prescribed procedural steps for communication, cost allocation, and conduct of the arbitral proceedings. The order was issued on 17 September 2026 and the parties were directed to appear before the arbitrator as directed.
