The court held that a valid arbitration agreement exists and, under Section 11 of the Arbitration and Conciliation Act, 1996, appointed Ms. Pranita Saboo as the sole arbitrator.

Summary

The applicant, IIFL Finance Limited, filed an application under Section 11 of the Arbitration and Conciliation Act, 1996 seeking the appointment of an arbitrator to resolve disputes arising from an agreement dated 28 June 2024. The applicant had served a notice of arbitration on 24 March 2026, but the respondent, Bestwell Polytube Industry Private Limited, neither replied nor filed an affidavit. The court examined the record and found that a valid and subsisting arbitration clause existed in Clause 26 of the agreement and that it had been duly invoked. Consequently, the court exercised its jurisdiction under Section 11 and appointed Ms. Pranita Saboo as the sole arbitrator, directing the parties to cooperate with the arbitrator and comply with statutory disclosure requirements. The order also stipulated cost sharing, procedural directions, and kept all merits issues open for determination by the arbitral tribunal.

Issues considered

  • Whether a valid and subsisting arbitration agreement exists between the parties.
  • Whether the court has jurisdiction to appoint an arbitrator under Section 11 of the Arbitration and Conciliation Act, 1996 despite the respondent's non‑response.
  • Whether the respondent's failure to reply affects the appointment of a sole arbitrator.
