The court held that a valid arbitration agreement exists and appointed Ms. Deepali A. Bagla as the sole arbitrator to adjudicate the disputes.

Summary

The applicant, Kotak Mahindra Bank Ltd., filed an application under Section 11 of the Arbitration and Conciliation Act, 1996 seeking the appointment of an arbitrator to resolve disputes arising from an agreement dated 18 November 2022. The court examined the notice issued by the applicant and found that the arbitration clause in the agreement had been validly invoked. Satisfied that a subsisting arbitration agreement existed, the court exercised its jurisdiction to appoint a sole arbitrator. Ms. Deepali A. Bagla was appointed as the sole arbitrator, with directions for communication of the order, disclosure statements, and procedural scheduling. The court also ordered that arbitration costs be borne equally by the parties, subject to the final award, and disposed of the application.

Issues considered

  • Whether a valid and subsisting arbitration agreement exists between the parties.
  • Whether the court has jurisdiction to entertain the Section 11 application for appointment of an arbitrator.
  • Whether the appointment of a sole arbitrator is appropriate under the facts.

                   P.C.:

differences stated to have arisen between the parties under an
Agreement dated 18 November 2022. The arbitration agreement
between the parties is contained in Clause 10.15 of the said
Agreement, a copy whereof is placed at page 49 of the Application.
