The Court appointed Mr. Rubin Vakil as the sole arbitrator to adjudicate the disputes between the parties.

Summary

Kalpataru International Projects Ltd. filed an application under Section 11 of the Arbitration and Conciliation Act, 1996 seeking the appointment of an arbitrator to resolve disputes arising from a work order dated 14 October 2024 with Krupay Industries. The parties had an arbitration clause (Clause 21) in their agreement requiring a sole arbitrator for such disputes, and the applicant had issued a notice of arbitration on 24 April 2026. The High Court examined the existence of a valid arbitration agreement and the parties' consent to refer the matter to arbitration. The Court appointed Mr. Rubin Vakil, an advocate of the Court, as the sole arbitrator and directed procedural steps including disclosure statements and cost sharing. All substantive issues, including limitation, were left open for determination by the arbitrator, and the application was disposed of by the appointment order.

Issues considered

  • Whether the High Court should appoint a sole arbitrator under Section 11 of the Arbitration and Conciliation Act, 1996.
  • Whether the arbitration agreement in Clause 21 is enforceable and sufficient to refer the disputes to arbitration.
