The court held that a valid arbitration agreement existed and duly appointed a sole arbitrator to hear the disputes.

Summary

The applicant filed an application under Section 11 of the Arbitration and Conciliation Act, 1996 seeking the appointment of an arbitrator to resolve disputes arising from an agreement dated 16 July 2013. The court examined the notice of arbitration dated 16 May 2026 and the respondent's reply, and found that the arbitration clause in Clause 36 of the agreement had been validly invoked. Satisfied that a subsisting arbitration agreement existed, the court appointed Mr. Cyrus Jal, an advocate of the court, as the sole arbitrator to adjudicate the matters. The order directed the parties to provide contact details, required the arbitrator to issue a statutory statement of disclosure under Section 11(8) and Section 12(1), and stipulated that arbitral costs be borne equally unless altered by the final award. The application was consequently disposed of, with directions for the conduct of the arbitral proceedings.

Issues considered

  • The existence and validity of the arbitration agreement between the parties.
  • Whether the court has jurisdiction to appoint an arbitrator under Section 11 of the Arbitration and Conciliation Act, 1996.

the Arbitration and Conciliation Act, 1996 (“the Act”), seeking the
appointment of an Arbitrator for adjudication of the disputes and
differences stated to have arisen between the parties under an
