The court held that a valid arbitration agreement subsists and appointed Mr. Cyrus Jal as the sole arbitrator to adjudicate the disputes.

Summary

The applicant, CMR Surgical India Pvt Ltd, filed an application under Section 11 of the Arbitration and Conciliation Act, 1996 seeking the appointment of an arbitrator to resolve disputes arising from an agreement dated 28 February 2022. The court examined the arbitration clause in the agreement and found that the arbitration agreement had been validly invoked by the applicant’s notice dated 18 November 2025. Satisfied that a subsisting arbitration agreement existed, the court exercised its jurisdiction to appoint a sole arbitrator. Mr. Cyrus Jal, an advocate of the court, was appointed as the sole arbitrator and directed to issue a statutory statement of disclosure under Section 11(8) and Section 12(1). The parties were instructed to cooperate with the arbitrator, provide contact details, and bear arbitration costs equally pending any award. The application was consequently disposed of.
