The Court extended the arbitral tribunal’s mandate by six months under Section 29A of the Arbitration and Conciliation Act, 1996.

Summary

The petitioners, Sushma Shivkumar Daga and another, filed a petition under Section 29A of the Arbitration and Conciliation Act, 1996, seeking an extension of the arbitral tribunal’s mandate. The arbitration was at the stage of final arguments and there was no objection from the respondents to a time extension. The Court observed that extending the time would best serve the substantive interests of justice. Accordingly, the Court extended the time for the arbitration proceedings by six months, directing both parties to cooperate. The petition was allowed.

Issues considered

  • Whether the arbitral tribunal’s mandate may be extended under Section 29A of the Arbitration and Conciliation Act, 1996?

               P.C.

               1. Mentioned. Not on Board. Taken on Board.

               2. This is the Petition filed under Section 29A of the Arbitration and

Conciliation Act, 1996, and seeks an extension of the mandate of the Arbitral

Tribunal to complete the arbitration proceedings and pass an arbitral award.

               3. There is no objection to the time being extended.

               4. I am informed that the arbitration proceedings are at the stage of final

arguments. In my view, the substantive interest of justice would best be served if

the time is extended. I am now extending the time for a period of six months.

               5. The Tribunal shall endeavour to complete the arbitration proceedings

within a period of six months, for which purpose both parties are directed to

               cooperate.
