The court allowed the petition and extended the arbitral tribunal’s mandate by one month to complete the arbitration and publish its award.
Summary
The petition was filed by Parekh Corporation under Section 29A of the Arbitration and Conciliation Act, 1996, seeking a court order to extend the mandate of the arbitral tribunal so that it may complete the arbitration and publish its award. The petitioner relied on an affidavit of service to demonstrate that the respondent, Sairaj Quikr India Private Limited, had been duly served. The petitioner contended that the arbitration arguments had concluded and only the award remained to be issued. The court examined whether the service was proper and whether the tribunal could be directed to issue its award within an extended time‑frame. Finding no impediment, the court allowed the petition and granted a one‑month extension for the tribunal to complete its work and publish the award.
Issues considered
- Whether the court may, under Section 29A of the Arbitration and Conciliation Act, 1996, extend the mandate of an arbitral tribunal to complete proceedings and render an award.
- Whether the affidavit of service suffices to establish proper service on the respondent.
