Bombay High Court

SUKHADEO CHANGDEO FARTADE AND ANOTHERversusSHIVAJI MARUTI UPASE AND OTHERS

Disposal
DISPOSED OFF

Holding

The contempt petitions are disposed of as the order under contempt has been complied with.

Summary

The High Court considered three contempt petitions (Nos. 117, 118 and 120 of 2014) arising from an order that directed the respondents, an acquiring body, to decide an application under Section 28‑A of the Land Acquisition Act, 1894. The respondents produced a letter dated 29‑03‑2014 indicating that the award under Section 28‑A had been passed and the compensation amount deposited with the Special Land Acquisition Officer. The court examined the letter and found it satisfactory evidence of compliance with the contempt order. Consequently, the court held that the requirement imposed by the contempt order had been fulfilled. All the contempt petitions were therefore disposed of.

Issues considered

  • Has the order under contempt directing the decision of the application under Section 28‑A of the Land Acquisition Act, 1894 been complied with?
  • Should the contempt petitions be dismissed on the basis of compliance?
