A decree of admission may be passed based on the parties’ consent terms, thereby effecting settlement of the suit.

Summary

The commercial suit between Grindwell Norton Limited and Preetham Reddy was settled by mutual consent. The parties submitted consent terms, which were signed by the plaintiff’s attorney and the defendants, and were recorded by the Court. The defendants, through their advocate, agreed to a decree of admission covering prayer clauses (a), (b), (c) and (e) of the plaint, and the Court accepted the consent terms as an undertaking. Accordingly, the suit was decreed in accordance with those clauses and the court fees were ordered to be refunded. The Court Receiver’s report was disposed of, the receiver discharged without accounts, and all related costs were directed to be paid by the plaintiff within eight days.
