The appeal is disposed of upon the appellant’s withdrawal and acceptance of the tribunal’s award.
Summary
The New India Assurance Co. Ltd. filed a first appeal against a motor accident claim award but subsequently withdrew the appeal after accepting the award of the Motor Accident Claims Tribunal, Latur (Petition No. 87 of 2010). The insurer deposited Rs.25,000 with the court and promised to deposit the balance compensation with accrued interest within eight weeks. The appellant sought permission to withdraw the appeal and to have the award drawn up accordingly. The Special Lok Adalat, acting under Section 19 of the Legal Services Authorities Act, 1987, accepted the withdrawal and ordered the appeal to be disposed. It also directed that the remaining amount be deposited with the court registry, the claimant be informed, and the court fee refund be processed as per law.
Issues considered
- Whether an appellant can withdraw a first appeal after accepting the award of a Motor Accident Claims Tribunal
- Whether partial deposit of the awarded amount satisfies the court’s requirement pending full payment
