Bombay High Court

STATE OF MAHARASHTRAversusGOVIND MANIKRAO KALE

Disposal
DISMISSED

Holding

The appeal is dismissed as the compensation awarded is within the four‑times limit prescribed by the State Government's policy.

Summary

The State of Maharashtra appealed a judgment and award dated 10 April 2000 of the Beed District Land Reference Court in favor of Govind Manikrao Kale. The State argued that a Government Resolution dated 3 November 2016, and its corrigendum dated 23 February 2017, directed that the State would not file or contest any appeal where the compensation awarded by the Reference Court is within four times the amount awarded by the State Land Acquisition Officer (S.L.A.O.). The learned Advocate General for the State submitted that the present appeal fell within this threshold. The bench considered the State's policy decision and the submissions of the Advocate General. Accordingly, the court disposed of the first appeal, effectively dismissing it in accordance with the State’s policy.
