Bombay High Court

MRS. CORINNA VALENTINA D'SOUZA AND ORS.versusUNION OF INDIA THROUGH THE GENERAL MANGAER, WESTER RAILWAY

Decided

Holding

The Court ordered that appellant No.1 receive one‑third of the compensation and appellant No.2 (minor) receive two‑thirds, to be held in a fixed deposit until the minor attains majority.

Summary

The appellants, Corinna Valentina D’Souza and others, appealed against a judgment of the High Court dated 18 March 2026 concerning compensation awarded by the Union of India. The original judgment did not specify the exact division of the compensation between the adult appellant and the minor appellant. The Court, by this order dated 7 May 2026, modified the earlier judgment to allocate one‑third of the compensation to appellant No.1 and two‑thirds to appellant No.2, who is a minor. It further directed that the minor’s share be placed in a fixed deposit with a nationalised bank until she reaches majority, after which the amount will be credited to her account. No new legal reasoning was provided beyond the amendment, and the order was to be read in conjunction with the original judgment.
