The Court held that the withdrawal of the first appeals is permissible and consequently ordered the disposal of all such appeals and any pending civil applications.
Summary
The New India Assurance Company (appellant) filed multiple first appeals before the Special Lok Adalat, High Court of Bombay, Aurangabad Bench, challenging Motor Accident Claim Tribunal awards in various motor accident claim petitions. The insurer had already accepted the Tribunal awards, deposited the compensation amounts with the Court registry, and sought to withdraw its appeals. The appellants submitted withdrawal pursis and an authority letter authorizing the withdrawal. The Court considered whether the appeals could be withdrawn after the compensation had been deposited and whether the matters could be disposed of without further adjudication. It held that the withdrawal of the appeals was permissible and ordered the disposal of all the first appeals and any pending civil applications. The Court directed that the awards be drawn up, the insurer communicate the withdrawal to claimants, and that court fees be refunded as per law.
Issues considered
- The permissibility of withdrawing first appeals after the insurer has deposited compensation with the Court registry.
- The authority of the Special Lok Adalat to dispose of multiple appeals and pending civil applications upon withdrawal.
