Bombay High Court

NEW INDIA ASSURANCE COMPANY LTDversusNANDLAL DEVIDAS DHANGARE AND ORS

Disposal
DISPOSED OFF

Holding

The Court held that the withdrawal pursis filed by the insurer effectuate the disposal of all pending first appeals, and claimants may withdraw the deposited compensation with interest as directed by the Tribunal.

Summary

The Special Lok Adalat of the Bombay High Court, Aurangabad bench, heard a batch of first appeals filed by New India Assurance Company Ltd. against various claimants arising from motor accident claim petitions. The insurer had accepted the awards rendered by the Motor Accident Claims Tribunal, Aurangabad, and deposited the compensation amounts with the Court Registry. It subsequently filed withdrawal pursis and an authority letter, seeking to withdraw all the appeals and allow claimants to collect the deposited sums with interest. The Court accepted the withdrawal, ordered that the appeals stand disposed, and directed that the award be drawn up and court fees refunded as per law. The insurer also undertook to inform the claimants and their counsel of the withdrawal.

Issues considered

  • Whether the filing of a withdrawal pursi by the appellant suffices to dispose of pending first appeals before the Special Lok Adalat.
  • Whether claimants are entitled to withdraw the deposited compensation amounts with accrued interest without further order of this Court.
