A withdrawal pursi filed by the appellant results in the automatic disposal of the pending first appeals.
Summary
The Special Lok Adalat of the Bombay High Court, Aurangabad bench, heard a batch of first appeals filed by New India Assurance Company Ltd. against various claimants arising from motor accident claim petitions decided by the Motor Accident Claims Tribunal, Aurangabad. The insurance company submitted withdrawal pursis and an authority letter dated 25.03.2026, indicating its acceptance of the Tribunal awards and its intention to withdraw all appeals. The court noted that the compensation amounts, together with accrued interest, had already been deposited with the Registry and could be withdrawn by the claimants as per the Tribunal’s directions. Consequently, the court ordered that, on receipt of the withdrawal pursis, all the first appeals and any pending civil applications be deemed disposed of. The award was to be drawn up accordingly, the insurer was to inform the claimants of the withdrawal, and the refund of court fees was to be processed as per law.
Issues considered
- What is the effect of a withdrawal pursi on pending first appeals before the Special Lok Adalat?
