Disposal
DISPOSED OFF

Holding

The appeal was disposed of upon the appellant’s withdrawal of the appeal.

Summary

The Branch Officer of New India Insurance Co. Ltd. filed a first appeal against a motor accident claim judgment. The insurance company later submitted a withdrawal pursis and authority letter, indicating that it had accepted the Motor Accident Claims Tribunal’s award and deposited the full compensation with interest. The appellant argued that the claimant could now withdraw the compensation amount as directed by the Tribunal, rendering further court involvement unnecessary. The Special Lok Adalat, noting the withdrawal, disposed of the appeal and any pending civil applications. The court ordered the award to be drawn up, the insurer to inform the claimant, and the refund of court fees to be processed.

Issues considered

  • Whether a first appeal can be withdrawn after the appellant has accepted the award and deposited the full compensation.
