The appeal is disposed of in view of the settlement, with the agreed compensation to be paid to the claimants and the balance with interest to the insurer.

Summary

The New India Assurance Co. Ltd. filed a first appeal before the National Lok Adalat in Aurangabad against Laxmibai Bhatu Thakare and others. The parties were referred to the Lok Adalat for settlement, and a compromise was tendered, including an Aadhaar extract and authority letter. The panel, after verifying the identities and confirming that respondent No.4, a minor, was protected by a certificate of interest, approved the settlement terms. Under the agreement, Rs.9,00,000 will be paid to the claimants (respondents 1, 2 and 4) as full and final settlement, with the remaining amount plus interest to be paid to the appellant insurer. The court ordered the refund of court fees as permissible and disposed of the appeal on the basis of the settlement.

Issues considered

  • Whether the dispute is amenable to settlement before the National Lok Adalat under the Legal Services Authorities Act, 1987.
  • Whether the compromise is in the interest of the minor respondent and requires a certificate of interest.
  • How the settlement amount should be allocated between the claimants and the appellant insurer.
