VYANKATRAO MANIKRAO SHINDE AND ANRversusTHE STATE OF MAHARASHTRA AND ORS
- Disposal
- PARTLY ALLOWED AND PARTLY DISMISSED
Holding
The appeal is partly allowed, modifying the compensation to Rs 60,000 per acre and granting statutory benefits and interest under the Land Acquisition Act, 1894, in line with the earlier decision in First Appeal No.276 of 2013.
Summary
The appellant challenged a land acquisition award dated 12‑12‑2006 concerning land in Gaundgaon for the Uppar Manar Project. The appellant argued that the dispute was identical to that decided in First Appeal No.276 of 2013, an order dated 13‑08‑2026, and should be resolved accordingly. The respondents accepted this position. The Court, agreeing that the controversies were the same, partially allowed the appeal, modifying the award to grant compensation of Rs 60,000 per acre, all statutory benefits under the Land Acquisition Act, 1894, and interest under Sections 28 and 34 as laid down in State of Maharashtra v. Kailash Shiva Rangari. The remainder of the award was left unchanged and the modified award was to be drawn accordingly.
Issues considered
- Whether the present appeal is identical to the earlier appeal and can be decided by reference to the earlier order
- What compensation amount is appropriate for the acquired land
- Whether the claimants are entitled to statutory benefits under the Land Acquisition Act, 1894
- Whether interest under Sections 28 and 34 of the Land Acquisition Act, 1894 is payable

3. The learned counsel for the appellant has tendered across the Bar a
copy of order dated 13.08.2026 passed by this Court in First Appeal No.276

same village Gaundgaon, for the same public purpose i.e.Uppar Manar
