Bombay High Court

THE STATE OF MAH AND ORSversusBASHIRODDIN KARIMODDIN SAYYAD

Disposal
DISPOSED OFF

Holding

The appeal was dismissed because the compensation awarded was within the four‑times limit prescribed by the State Government's resolution.

Summary

The State of Maharashtra appealed a judgment of the Latur Land Reference Court that awarded compensation to Bashiruddin Karimoddin Sayyad. The State argued that a Government Resolution dated 03.11.2016, with a corrigendum on 23.02.2017, directs the government not to file or contest any appeal where the compensation awarded is within four times the amount awarded by the State Land Acquisition Officer (SLAO). The court examined this policy and found that the compensation awarded by the Reference Court fell within the four‑times limit. Accordingly, the court held that the appeal should not proceed. The appeal was therefore disposed of, effectively dismissing the State's challenge.

Issues considered
