Bombay High Court
THE STATE OF MAH AND ORSversusBHANUDAS SANTRAM SHINGADE
- Disposal
- DISMISSED
Holding
The High Court held that the reference court's award did not exceed the four‑times limit and, in view of the Government's resolution, there was no ground to interfere, leading to dismissal of the appeals.
Summary
The State of Maharashtra filed multiple first appeals challenging awards dated 23 February 2007 in land acquisition proceedings of 1996. The trial court had awarded compensation, which the reference court enhanced, but the State argued the enhancement exceeded four times the amount awarded by the State Land Acquisition Officer. The State Government, through Resolution No. Sankirna‑2014/Prak.Kra.4/Bham‑1/A‑4 and subsequent corrigenda, declared it would not contest reference awards that increased compensation only up to four times. The High Court examined the resolution and the award, finding no basis to intervene as the enhancement was within the stipulated limit. Accordingly, the Court dismissed all the appeals and ordered the disposal of any pending civil applications.
Issues considered
- Whether the reference court's enhancement of compensation exceeds the four‑times limit prescribed for land acquisition awards.
- Whether the State Government's resolution precludes judicial intervention in reference court awards that are within the four‑times limit.
- Whether the appellate court should set aside the reference court's award on the ground of excess compensation.
