Bombay High Court

DADARAO GANPATRAO KAVLEversusTHE STATE OF MAHARASHTRA THROUGH THE COLLECTOR JALNA AND ORS.

Disposal
PARTLY ALLOWED AND PARTLY DISMISSED

Holding

The Court allowed the appeals partly, awarding the appellants Rs.2400 per Are and interest under Sections 28 and 34, but denied interest and statutory benefits for the delayed period.

Summary

The Bombay High Court, Aurangabad Bench, heard a group of first appeals challenging the compensation awarded for lands acquired in Kedarwakadi village for the "Nimmna Dudhana" project. The appellants, members of the KavaLe family, sought enhancement of the compensation rate from Rs.1500 per Are (for jirayat land) and Rs.750 per Are (for pot kharab land) to Rs.2400 per Are, claiming parity with a prior decision. The State contested the claim, arguing that the earlier award was proper. Relying on a precedent (First Appeal No.1896 of 2021) and the principles laid down in State of Maharashtra v. Kailash Shiva Rangari, the Court held that the appellants are entitled to the higher rate of Rs.2400 per Are and interest under Sections 28 and 34 of the Maharashtra Land Acquisition Act, but not for the delayed period. The Court allowed the appeals partly, modified the award accordingly, and ordered the appellants to pay deficit court fees.

Issues considered

  • Whether the appellants are entitled to an enhanced compensation rate of Rs.2400 per Are for jirayat land.
  • Whether interest under Sections 28 and 34 of the Maharashtra Land Acquisition Act is payable on the award.
  • Whether statutory benefits for the period of delay are applicable.
