Summary
The Special Lok Adalat of the Aurangabad Bench of the High Court heard a batch of first appeals filed by New India Assurance Co. Ltd. concerning motor accident claim petitions. The insurer had accepted the awards of the Motor Accident Claims Tribunals and deposited the compensation amounts with the Court Registry. It sought to withdraw all the appeals and requested that claimants be allowed to collect the deposited sums with accrued interest. The Court condoned the delay in filing the appeals, accepted the withdrawal letters, and ordered that the appeals and any pending civil applications be disposed of. It further directed that the insurer communicate the withdrawal to the claimants and that any court‑fee refunds be processed as per law.
Issues considered
- Whether the delay in filing the first appeals can be condoned under the applicable procedural rules.
- Whether an appellant may withdraw pending first appeals after accepting the tribunal awards and depositing compensation.
- Whether the Court can order a refund of court fees upon withdrawal of the appeals.
