The Lok Adalat accepted the settlement, waiving the claimants' right to enhancement and ordering the State to pay the agreed compensation within the stipulated period.

Summary

The National Lok Adalat of the High Court of Bombay, Aurangabad bench, heard a large number of first appeals filed by various private claimants against the State of Maharashtra concerning compensation for the acquisition of land bearing fruit trees. The parties, represented by counsel, presented settlement agreements which were recorded as Exhibit‑X. The claimants agreed to waive any claim for enhancement of compensation for the fruit‑bearing trees, and the acquiring authority consented to pay the agreed compensation within eighteen months, depositing the amount with the High Court. The award provides that the deposited amount, together with any accrued interest, will be disbursed to the claimants, and stipulates a 9% per annum interest penalty if payment is delayed. The Lok Adalat disposed of all the appeals by accepting the settlement.

Issues considered

  • Whether the claimants are entitled to compensation for fruit‑bearing trees under the land acquisition law
  • Whether the claimants can claim enhancement of the compensation awarded
  • Whether the National Lok Adalat has jurisdiction to settle the disputes and bind the parties
