Bombay High Court

DATTARAO DADARAO KAVALE DIED THR LRS SARUBAI AND ANRversusTHE STATE OF MAHARASHTRA THROUGH THE COLLECTOR JALNA AND ORS.

Disposal
PARTLY ALLOWED AND PARTLY DISMISSED

Holding

The Court held that the appellants are entitled to compensation at Rs.2400 per are and interest under Sections 28 and 34, but not for the delayed period.

Summary

The appellants challenged the compensation awarded for lands acquired for the Nimmna Dudhana project, arguing that the rate of Rs.1500 per are for jirayat land and Rs.750 per are for pot kharab land was too low. They sought enhancement to Rs.2400 per are on the ground of parity with a prior judgment (FA No.1896 of 2021). The Court examined the earlier order and the principle of parity, and held that the appellants were entitled to the higher rate. It also directed that interest under Sections 28 and 34 of the Maharashtra Land Acquisition Act be payable, referencing the State of Maharashtra v. Kailash Shiva Rangari. However, the Court denied interest and statutory benefits for the period of delay. The appeals were partially allowed, the compensation rate was increased, and the original award was otherwise left unchanged.

Issues considered

  • Whether the appellants are entitled to an enhanced compensation rate of Rs.2400 per are on the basis of parity with earlier awards.
  • Whether interest under Sections 28 and 34 of the Maharashtra Land Acquisition Act is payable on the enhanced compensation.
  • Whether statutory benefits and interest are applicable for the period of delay in payment.
