The Court disposed of all the first appeals, accepting the insurer's withdrawal and allowing claimants to withdraw the deposited compensation with interest.
Summary
The Special Lok Adalat of the High Court at Aurangabad heard a batch of first appeals filed by Reliance General Insurance Co. against various claimants arising from Motor Accident Claim Tribunals. The insurer submitted an email instruction, on behalf of its advocate Mr. R.H. Dahat, withdrawing all the appeals and confirming that the compensation awards had already been deposited with the Court registry. The claimants were permitted to withdraw the deposited amounts with accrued interest as directed by the Tribunals, without further reference to the Court's order. The Court condoned the delay in filing and ordered that the first appeals, along with any pending civil applications or objections, stand disposed of. It directed that the award be drawn up accordingly, the insurer communicate the withdrawal to the claimants, and the refund of court fees be processed as per law. Consequently, all the appeals were closed and the matter was concluded.
Issues considered
- What is the effect of a party's withdrawal of a first appeal after the award has been deposited with the Court?
- Whether the Court can condone delay in filing the withdrawal and dispose of the appeals without further hearing?
- Whether claimants may withdraw the deposited compensation and interest without a fresh order from the Court?
