No interference is warranted where the Reference Court's compensation is within four times the SLAO's award, especially in view of the State Government's policy not to challenge such references.
Summary
The Municipal Commissioner, Nanded Waghala City Municipal Corporation, filed a batch of First Appeals challenging the Reference Court's orders awarding enhanced compensation. The learned AGP submitted that the compensation granted by the Reference Court was within four times the compensation granted by the SLAO. The State Government, by Government Resolution No. Sankirna-2014/Prak.Kra.4/Bham-1/A-4 dated 03.11.2016, with corrigenda dated 23.02.2017 and 13.08.2018, had decided not to challenge references where compensation was enhanced only up to four times. The Court considered the submissions and found no reason to intervene with the impugned orders. Accordingly, the First Appeals were dismissed. Pending civil applications, if any, were disposed of as not surviving.
