RELIANCE GENERAL INSURANCE CO. THR ITS MANAGERversusSANGEETA BALAJI INGOLE AND ORS

Disposal
DISPOSED OFF

Holding

All the first appeals and related applications were disposed of upon the insurer's withdrawal and acceptance of the Tribunal awards.

Summary

The Special Lok Adalat of the Bombay High Court, Aurangabad bench, heard a batch of first appeals filed by Reliance General Insurance Company against various claimants in motor accident claim matters. The insurer, through its advocate Mr. R.H. Dahat, submitted email instructions withdrawing all the appeals, having already accepted the awards of the Motor Accident Claims Tribunal and deposited the compensation amounts with the court registry. The court noted that the claimants could now withdraw the compensation along with accrued interest as per the Tribunal's directions, without further reference to the court's order. Consequently, the court disposed of all the first appeals and any pending civil applications or objections, directing that the awards be drawn up and court fees refunded. The insurer undertook to inform the claimants and their counsel of the withdrawal.

Issues considered

  • Whether a party may withdraw a first appeal after accepting the award of the Motor Accident Claims Tribunal and depositing compensation with the court.
  • Whether the court can dispose of multiple appeals and related applications on the basis of such withdrawal.
