The Lok Adalat awarded a full and final settlement of Rs.14,00,000 to be deposited by the insurance company within 45 days, with interest for delay, and ordered refund of court fees.

Summary

In a First Appeal before the National Lok Adalat (High Court of Bombay, Aurangabad Bench), the appellants Rani Santosh Palewad and others sought settlement of a motor accident claim against Shri Shikant Govindrao Shrimangale and others, including an insurance company. The parties, represented by advocates Hanmant B. Nandgavale (appellants) and R. H. Dahat (respondent No.3/insurance company), presented settlement terms and supporting documents such as Aadhaar extracts. The Lok Adalat panel, headed by Justice Shailesh P. Brahme, approved a full and final settlement of Rs.14,00,000 payable by the insurance company. The award directed the insurance company to deposit the amount with the Motor Accident Claims Tribunal, Latur, within 45 days, with a 6% per annum interest for non‑compliance. Upon deposit, the amount is to be disbursed to the claimants, and the court fees are to be refunded as per law.

Issues considered

  • Whether the parties may settle the motor accident claim through the National Lok Adalat under the Legal Services Authorities Act, 1987.
