Bombay High Court

MANIKA MADHAVRAO NUKULWADversusTHE STATE OF MAHARASHTRA THROUGH THE COLLECTOR NANDED AND ORS

Disposal
PARTLY ALLOWED AND PARTLY DISMISSED

Holding

The appeal is partly allowed; the market value is fixed at Rs 1,25,000 per hectare and compensation is enhanced per the dry‑land categorisation with interest as per Sections 28 and 34 of the Land Acquisition Act, 1894.

Summary

The appellant, original owner of 0.84 hectare of land in Marajwadi, Nanded, challenged the compensation awarded for acquisition of his land for the Lendi major project, arguing that the amount of Rs 60,769 per hectare was insufficient. After a reference court enhanced the compensation to Rs 72,586 per hectare, the appellant sought further enhancement, invoking parity with other appeals where similar lands received higher awards. Both the acquiring body and the state agreed that the land fell under the same notification and award. The High Court, noting the consensus and the principle of parity, partially allowed the appeal, fixing the market value at Rs 1,25,000 per hectare and directing that compensation be enhanced according to the land’s dry‑land categorisation, with statutory interest calculated under Sections 28 and 34 of the Land Acquisition Act, 1894 as per State of Maharashtra v. Kailash Shiva Rangari. The acquiring body was ordered to deposit the enhanced amount within three months.

Issues considered

  • Whether the appellant is entitled to a further enhancement of compensation on the basis of parity with other similar appeals
  • Whether statutory benefit and interest under Sections 28 and 34 of the Land Acquisition Act, 1894 apply to the enhanced compensation
  • Determination of the appropriate market value of the acquired land

claimant has filed the present Appeal for further enhancement of

compensation.

2. The learned Advocate for the Appellant submits that in the

group of First Appeals filed before this Court vide Judgment dated 16 th

January, 2019 has granted enhancement of compensation granted to the

claimants as per the classification of land made by the Special Land

Acquisition Officer. It is submitted that the land of the present Appellant

is acquired for the same project and is covered by the same notification as

well as the award, therefore, the claimant needs to be granted similar

enhancement, as has been granted by this Court in First Appeal No.3133

2009 and group of Appeals.

well as the learned Addl. G.P. do not dispute about the position that the

land of the present Appellant is also covered by the same notification as

well as the same award. In view of the consensus between the parties, the

land of the Appellant is covered by the Judgment passed by this Court.

Similar relief is extended to the Appellant on the ground of parity and

accordingly, I pass the following order :
