Bombay High Court

RELIANCE GENERAL INSURANCE CO.versusVAISHALI VIJAYKUMAR PATIL AND ORS

Disposal
DISPOSED OFF

Holding

The court held that the insurer's withdrawal of the first appeals and acceptance of the Tribunal awards warrants the disposal of all the appeals.

Summary

The Special Lok Adalat of the High Court of Bombay, Aurangabad bench, considered a batch of first appeals filed by Reliance General Insurance Co. against various claimants in motor accident claim matters. The court condoned the delay in filing and recorded the insurer's email instruction to withdraw all the appeals. It noted that the insurer had accepted the awards of the Motor Accident Claims Tribunal and that the compensation amounts, along with accrued interest, had been deposited with the court registry. Accordingly, the court permitted the claimants to withdraw the deposited amounts and ordered that the first appeals be disposed of. The award was to be drawn up, the insurer was to inform the claimants of the withdrawal, and any refund of court fees would be processed as per law.

Issues considered

  • Whether the delay in filing the first appeals can be condoned under the procedural rules of the Lok Adalat.
  • Whether the insurer's withdrawal of the first appeals results in the disposal of those appeals.
  • Whether the claimants are entitled to withdraw the compensation amounts deposited with the court registry along with accrued interest.
