THE NEW INDIA ASSURANCE COMPANY LTDversusMANOHAR MADANLAL RATHI AND ORS

Disposal
DISPOSED OFF

Holding

The appeal is withdrawn and the first appeal and any pending civil application are disposed, allowing the deposited compensation to be released to the claimants with interest.

Summary

The New India Assurance Company Ltd filed a civil application and first appeal seeking to withdraw its appeal against the award of the Motor Accident Claims Tribunal, Ambajogai, in favour of the claimants Manohar Madanlal Rathi and others. The insurance company had already accepted the Tribunal’s award, deposited the compensation amount with the Court registry and filed a withdrawal petition dated 25‑03‑2026. The appellant argued that the claimants should be allowed to withdraw the amount together with accrued interest as per the Tribunal’s apportionment, without further reference to the Court’s order. The Special Lok Adalat, after considering the withdrawal petition, disposed of the first appeal and any pending civil application, directing that the award be drawn up and the amount released to the claimants. The Court also ordered the insurance company to inform the claimants of the withdrawal and to process a refund of court fees.

Issues considered

  • Whether the appellant can withdraw its appeal after accepting the Tribunal’s award and depositing the compensation with the Court registry
  • Whether the Court may direct payment of the deposited compensation with accrued interest without further reference to its own order
