Bombay High Court
SUBHASH JAGANNATH PATILversusTHE SPECIAL LAND ACQUISITION OFFICER, UPPER TAPI PROJECT,
- Disposal
- DISPOSED OFF
Holding
The appeal is disposed of in terms of the National Lok Adalat order, granting the specified compensation and interest as per the Land Acquisition Act.
Summary
The appellant challenged a 2006 judgment awarding compensation for land acquired for a medium project in Dhargir village. The appellant argued that the dispute had already been settled by a National Lok Adalat order dated 08.02.2020 in a related appeal, which fixed compensation rates for jirayat and bagayat lands and for fruit‑bearing trees. The respondent acquiesced to the Lok Adalat settlement and raised no objection to a similar order here. The Court, accepting that the controversy was already resolved, disposed of the present appeal in accordance with the Lok Adalat order, confirming the compensation rates, entitlement to interest under Sections 28 and 34 of the Land Acquisition Act, 1894, and other statutory benefits, while denying interest for any delay. The Court also ordered payment of any deficit court fees and the drawing of modified awards.
Issues considered
- Whether the present appeal is barred by the earlier National Lok Adalat settlement.
- Determination of appropriate compensation rates for jirayat and bagayat lands.
- Entitlement to interest on compensation under Sections 28 and 34 of the Land Acquisition Act, 1894.
- Whether claimants are entitled to interest for the delayed period.
- Application of consequential statutory benefits and court fee adjustments.

further submits that he has no objection to passing a similar order in the

controversy involved in the present appeal has already been settled before
the National Lok Adalat vide its order dated 08.02.2020 passed in First
