The Lok Adalat approved the settlement agreements and disposed of the first‑appeal petitions.
Summary
A large number of first‑appeal petitions filed by various claimants against the State of Maharashtra were heard before the National Lok Adalat of the High Court of Bombay, Aurangabad Bench. The claimants sought enhanced compensation for fruit‑bearing trees affected by land acquisition. The parties, through their counsel, presented signed settlement agreements covering each case. The Lok Adalat, invoking Section 19 of the Legal Services Authorities Act, 1987, accepted the settlements, ordering the acquiring authority to pay the agreed compensation within eighteen months and to deposit the amount with the High Court. It further stipulated that any delay would attract interest at 9% per annum, and that the deposited amounts be disbursed with accrued interest. Consequently, all the first‑appeal matters were disposed of by settlement.
Issues considered
- Whether the claimants are entitled to enhanced compensation for fruit‑bearing trees under the land acquisition proceedings
- Whether the settlement agreements presented by the parties are binding and can be approved by the Lok Adalat
