The Tribunal’s finding of negligence stands, the widow remains entitled to compensation despite remarriage, and the compensation must be enhanced per the Sethi decision with interest fixed at 7% per annum.

Summary

On 23 June 1992 a military wagon collided with the scooter of the deceased, Satish Gumaste, who later died. The claimants – his parents, widow and daughter – sought compensation under the Motor Vehicles Act, 1988 and the Motor Accident Claims Tribunal awarded Rs 6,28,860 with 9% interest, denying any share to the widow on the ground of her subsequent remarriage. The Union of India appealed, challenging the Tribunal's finding of negligence and the effect of the driver’s criminal acquittal, while the claimants cross‑objected for enhancement of the award and for the widow’s entitlement. The Court held that the Tribunal correctly identified negligence, that a widow’s later remarriage does not defeat her right to compensation, and that the quantum must be recomputed in line with National Insurance Co. Ltd. v. Pranay Sethi (2017) with interest reduced to 7% per annum. Accordingly, the compensation was enhanced to Rs 12,57,440 less the original award, resulting in an additional Rs 6,28,580, and the Union was directed to deposit the enhanced amount with the Tribunal.

Issues considered

  • The correctness of the Tribunal's finding of negligence of the military wagon driver.
  • Whether the driver’s criminal acquittal affects civil liability for compensation.
  • Whether a widow who remarries after the accident loses her right to compensation under the Motor Vehicles Act.
  • The appropriate quantum of compensation in light of the Supreme Court’s decision in National Insurance Co. Ltd. v. Pranay Sethi.
  • The appropriate rate of interest to be awarded on the compensation.

                                                 DATED : 27 July 2026
                 P.C. :

                 1. This appeal and cross objection have been filed by the Union of India
and the original claimants respectively, challenging the order dated 16
December 2003 passed by the Motor Accident Claims Tribunal, Pune
(‘Tribunal’) whereby Rs.6,28,860/- has been awarded to the claimants
alongwith interest @ 9% p.a. on account of death of Mr. Satish Gumaste.

                 2. Appeal was admitted on 4 May 2006.

                 3. I have heard Mr. Dighe, learned counsel for Union of India and Mr.
Malpathak, learned counsel for the original claimants.

                 4. On 23 June 1992, deceased was returning on his scooter. When he
reached Baner road, a military station Wagon came from the opposite side
and dashed with the scooter. The colleague of the deceased who was

travelling in a PMT bus coincidentally happened to be on the same road
where the people had gathered at the site of the incident. The colleague
took him to the government hospital and then to Sancheti hospital for
medical treatment. However, on 2 July 1992, Mr. Satish Gumaste passed
away.

5. The claimants being parents, widow and daughter of the deceased
made an application for compensation under the Motor Vehicles Act, 1988.
The Tribunal awarded Rs.6,28,860/- alongwith interest @ 9% p.a.
However, since the widow of the deceased had subsequently remarried, the
Tribunal denied compensation to her. The compensation was apportioned
between the daughter and the parents of the deceased in the ratio of half
and half i.e., 50%-50%. The parents were given one-fourth of half. Being
aggrieved by the aforesaid order, Union of India have filed the present
appeal and the claimants have filed a cross objection for enhancement.

6. At the outset, the impugned judgment was delivered on 16 December
2003 when the decision of the Hon’ble Supreme Court in the case of
National Insurance Co. Ltd vs Pranay Sethi & Ors. 1 was not available.
Therefore, to that extent, compensation awarded under the impugned order
would require modification in line with the said decision. There is no
dispute between the parties on this issue.

7. The contention of Union of India that the Tribunal's finding that the
driver of the military Wagon was negligent is incorrect. The contention is
that when the vehicle is taking a turn, it can never be at a high speed and
therefore, this finding is incorrect.

8. In my view, when the phrase “rash and negligent” is used by the
Tribunal, it need not necessarily mean only high speed but it would also

ppn 3 15.fa-640.05 wt xob.doc

include the negligence. The Tribunal in paragraph 15 of its order has
considered the spot panchnama for coming to the conclusion that the driver
of the military Wagon was responsible. The Tribunal has rejected the oral
evidence of the claimants but has proceeded on the documentary evidence.
The deceased was proceeding in west-east direction while the offending
vehicle was proceeding from east to west by that road. The spot panchnama
further records that the offending vehicle was found lying in a ditch which
is to the northern side of the road. Based on these facts, the Tribunal has
come to a conclusion that the offending vehicle went on the wrong side of
the road and dashed into the scooter and therefore, the accident took place.

9. In my view, no fault can be found with the Tribunal's order because
the Tribunal has considered the spot panchnama and documentary evidence
for coming to the conclusion that it was the driver of the offending vehicle
who was responsible and nothing contrary is shown to me.

10. The contention of the Union of India that the driver was subsequently
acquitted by a Criminal Court in Criminal proceedings and therefore, the
finding given by the Tribunal is not correct cannot be accepted. Admittedly,
there was no eyewitness to this incident and therefore, the Court came to
the conclusion that the charges levelled against the driver of the offending
vehicle were not proved. It was not on the merits that the acquittal order
was passed. Therefore, this contention cannot be accepted.

11. The contention of the learned counsel for the claimants that the
Tribunal was not justified in not awarding any amount to the widow on the
ground of her remarriage is justified. It is settled principle of law that this
issue has to be examined based on the position on the date of the accident.
On that date, the widow was not remarried and it was a subsequent event.
Merely because she subsequently remarries, she does not lose her right to
ppn 4 15.fa-640.05 wt xob.doc

claim compensation under the Motor Vehicles Act, 1988. Therefore, to that
extent, the Tribunal's finding is incorrect.

12. In view of above, the revised compensation after applying the
decision of Pranay Sethi (supra) is as under :-

      Sr. No. Particulars Amount (Rs.)
        1 Annual Income (Rs. 5,000 X 12) Rs.60,000/-

                                                        Rs.45,000/-

        7 Funeral Expenses Rs.18,000/-
        8 Medical Expenses Rs. 16,940/-
                Total Rs.12,57,440/-
Less granted by the Tribunal Rs.6,28,860/-
                Enhanced Amount Rs.6,28,580/-

13. The enhanced amount is Rs.6,28,580/- (Rs.12,57,440/- minus
Rs.6,28,860/-.)

14. The learned counsel for the claimants submits that the parents of the
deceased have expired after filing of the cross objection. He, therefore,
prays that necessary directions be issued to the Tribunal for handing over
the compensation amount to the widow and the daughter of the deceased. I
ppn 5 15.fa-640.05 wt xob.doc

agree with this submission. The claimants to produce death certificate of
the parents of the deceased so that the amount can be remitted only to the
widow and the daughter of the deceased.

15. Learned counsel for Union of India prayed that the interest awarded
is on the higher side. None of the parties have led any evidence with regard
to the rate of interest. It is also an accepted fact that the rate of interest has
moved southwards over a period of time. Therefore, in the interest of
justice, the rate of interest is fixed @7% p.a. which will factor the reduction
in rate of interest over a period of time. Therefore, to that extent, the order
of the Tribunal also stands modified.

16. Union of India to deposit the enhanced compensation alongwith
interest with the Tribunal within 12 weeks from today. The revised
calculation will be based on rate of interest @7% p.a. from the date of
application till the date of realisation. If any amount is deposited by the
Union of India, then credit should be given with regard to the amount
deposited. If any amount is withdrawn by the original claimants, then that
should be factored in while working out the revised calculation as per this
order.

17. Statutory deposit of Rs.25,000/- alongwith interest to be transferred
to the concerned Tribunal and the parties are at liberty to make an
application for refund of the same.

18. Appeal and the cross objections are disposed of in above terms.
